  • Multi-Agency Liability Protection: A FUDS Brownfield Redevelopment Challenge

    Take an old military research and testing facility, mix in a little commercial use as a self-storage and light industrial facility, then add a robust planned mixed-use retail, restaurant and multi-family development that intends to clean up the sins of the past and enrich the surrounding community, and what do you get? Besides a big challenge, you get an opportunity for creative thinking and actions on the part of the seller, developer/prospective purchaser, consultants and regulatory agencies. This session will delve into the complexities of crafting liability protections for the seller and prospective purchaser, the ability for the prospective purchaser (developer) to gain some level of certainty with respect to cleanup costs, and developing consensus and support by the City in which the project resides. Panelists consisting of representatives from the project consultant, developer and lead regulatory agency will also discuss the approaches to site cleanup that have been approved for the site. Controlling contaminants of concern for the planned re-mediation are polynuclear aromatic hydrocarbons (PAHs), heavy metals, total petroleum hydro-carbons (TPH), and Volatile Organic Compounds (VOCs). Community benefits of the project will be presented and discussed.
